ASSUMPTION OF RISKS, RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

BY ACCEPTING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

THIS RELEASE HAS NO EXPIRATION DATE AND SHALL BE DEEMED REAFFIRMED EACH TIME I PARTICIPATE IN ANY YAP CLUB EVENT.

A YAP Club Event will be referred to from now on as "EVENT."

I do hereby declare that I have read, understood, and accepted the following:

I understand that I am at all times responsible for my own safety when participating in an EVENT. I expressly agree and promise to accept and assume all of the risks existing in an Event. My participation in this activity is purely voluntary, and I elect to participate in spite of all known and unknown risks.

I understand and acknowledge that participation in some EVENTS can contain inherent dangers. I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF PERSONAL INJURY, PROPERTY DAMAGE AND DEATH SUSTAINED WHILE PARTICIPATING IN AN EVENT OF ANY TYPE whether from known or unknown causes.

YAP Club does not certify or confirm the qualifications of any of its members to lead or participate in trips. No warranty is implied or intended. I will not participate in an EVENT that I do not feel comfortable with prior to its beginning.

As a further express condition of being permitted to participate in EVENTS, I agree, for myself and for my heirs, assigns and representatives not to sue YAP Club, LLC, their event leaders,event hosts,event sponsors, respective owners, officers, directors, members, agents, employees or volunteers, and not to initiate or assist the prosecution of any claim for damages or cause of action which I or my heirs, assigns or representatives may have by reason of my suffering any personal injury, death or damage or destruction to my property arising from the activities contemplated by this agreement.

I will drink responsibly and not drive if inebriated. I understand that illegal drug usage is prohibited.

I agree for myself and my heirs, representatives and assigns to INDEMNIFY AND HOLD HARMLESS YAP Club LLC from any and all losses, claims, actions, causes or action, or proceedings of any kind which may be initiated by myself or by any other person or organization, including demands for damages, judgments, costs, loss of services or expenses, arising from the activities contemplated by this agreement, including but not limited to reasonable attorney fees incurred by YAP Club.

This Agreement is intended to be as broad as is permissible under the law of the State of Texas and this Agreement shall be interpreted under the laws of the State of Texas. If any portion of this Agreement is invalid and/or is declared to be invalid by a Court of Law, the balance of the Agreement shall continue in full force and effect.

I understand that at an event I may be photographed. I agree to allow my photo, video or film likeness to be used for any legitimate purpose by YAP Club.

I understand that this is a legal document. I agree to its terms voluntarily and with full knowledge of its meaning and significance.
